Yeah, I have proof of Nepal. My mom still has properties and farm land in nepal.
I read at few forums that Indian consultate does not entertain changing place or date of birth? are there any exceptions to that? Or have they changed policies?
Has anyone been able to change the place of birth?

Hello IV Freinds,
I checked my mail last Saturday, got Cards and welcome approval notices in mail. Status at USCIS website still shows all cases pending. I had called my Senators office for follow up week before as processing dates also had also passed.
I appreciate IV for providing this website for sharing our immigration issues and concerns in this long journey.
Good luck to all IV members who are still awaiting for good day to come.

I took infopass to clarify my situation with 2 I-485, different A#, and one I-140.
The IO verified and told me that both Apps have been merged and keying in either A# has brought back both Appslications. There was a LUD few weeks before I took infopass. I think it may have been because of merge.

I think you there should not be problem as you have new job offer...
One thing I could not understand , why have they called for interview ? I know few people in similar situation got their GC mailed to them.
Have you informed USCIS about AC-21 after leaving petitioner epmloyer ?

A friend is currently working full time with a large financial company where there are many layoffs going on. She has 140 approved, but her H1 is valid only till Sept 2009 (6 years complete; no date recoup possible).
H1 extension cannot be filed until 6 months prior to expiry i.e. Apr 2009.
questions -
If she gets laid off (next round of layoffs are expected in dec), can she still:
1) transfer her h1 (she is worried because many companies do not transfer if < 1 year is on h1), and simultaneously file for an H1 extension based on approved 140 from her current job?
2) file a new labor and port her PD from the approved 140?
3) if no to 1 or 2 - is it the end of the road? Can she transfer to H4 (on her husbands H1) and continue to stay here?

Thanks for your response. I'm leaning more towards Canada as I can avoid travel with my baby to India.
Do you think they might reject the case for any reasons?

if its approved I think you get it back the same day (that was back in 2007)
if you get stuck in administrative processing it can take few weeks to months - check forums/threads on that topic

I got stuck in FBI name check for over 2+ years (24+ months)... run out of
patience or anything :mad: . I now decide to sue them by filing writ of mandamus in court. I'd like to have an experienced attorney do it for me. I'm looking for an attorney who is responsible and responsive, has been successful in filing writ of mandamus for clients to get the name check moving. The vermont service center says 2 months for h1b extensions, mine has been pending for 75 days, so i called the uscis today and guess what they told me, the processing times have been updated on teh web site but it is very difficult for us to follow them, i would suggest you wait for 90 days and see if there is any change in your online status if not call me back.
Then why do these people keep updating monthly processing dates if they cannot stick to their words.
I believe the processing times are just a gimmick to show progress to press....:mad:

Please let me know, after how many days u got u'r extention.....am also in same situation .My H1-B extension was filed on sept 1st,requesting for additional 3 years (after the 1st 6 yrs) to VSC on regular basis. My labor and I-140 were also approved. The case has been pending since then.

Able to read English or not should not constitute an offense. Not able to read a road sign and erring on that basis is an offense. All the regulatory and warning road signs have a symbol associated with the text (Octogon for stop 'U' for U-turn, curve ahead.....). Only the advisory signs (exit signs and street signs) have English names and no signs.

A few days ago there was a soft LUD on my spouses and my I485 applications. I am the primary applicant and I also had a LUD on my I140(approved in 2006).
Then a couple of days later the message changed for my spouse and we recieved a physical notice in the mail from USCIS. The notice stated that-
Only my spouses I 485 application was transferred from TSC to NSC. The reason for transfer of the application was "faster processing".
Has anyone had this experience where the derivative application was sent to another service center but the Primary application remained in the original center.
My lawyer says this is normal processing.

Please consider signing up for monthly recurring contributions. It will be a big help to IV and we can plan our lobbying efforts in the coming months ahead of time.
It seems people will wake up only after they are stuck in the 485 and EAD backlogs and ask IV to do something for them. It will be too late by then. The more we get closer to the presidential election, the lesser chances we have to get any relief. Hope all members realize this truth.

wooah...i got the problem solved.
The problem we had was, we got the pay from jan to may but the employer gave all the pay just for pay period May instead of individual months.
NY ways, i consulted a attorney and he suggested few things....

By now perhaps the orginal poster is travelling to India. He can return to US on an unexpired H-1 visa with new H-1B documents. But it is difficult to get a H-4 stamp unless the new H-1 petition is approved.

Yes we got the card after a month.
It went to a place where we never lived not sure how it went there.
Anyway we didnt get the notices yet.
